Taking IW Council to Judicial Review – West Acre Park (WAP) case progressing!

Save Westridge Farm Campaign (crowdjustice.com) – has been updated by Greenfields (IOW) Ltd which is the company established by residents in Ryde Appley and Elmfield Ward to seek Judicial Review. This update is printed below and it the links below enable you to get details of the case and how it is progressing.

On reflection, it is an incredible achievement for my residents as it the first time I have known IW residents to organise, raise funding through a crowdfunding site, find experienced lawyers and barristers, collated a strong case (65 pages with a 2000 page attachment/bundle with 1000s of pieces of evidence of errors/mistakes). This is a true David and Goliath fight with residents being David and IW Council and Developers, Goliath. The resilience of my residents in this fight is outstanding. It is a truly courageous. It is an amazing story!

The documents are worth a detailed read (see links) as this case highlights huge flaws in the process. I wish to put out a huge thank you to all those involved and support their fight to get justice for the community, the environment and the Curlew!

Apologies for length of this post, but it is a major update.

Firstly, thanks to all those who have pledged funds, and made this case for justice possible.

Following lodging the case at High Court London 15th Sept it is now possible to make the following documents available to read:

Once the case was lodged it was sent to IW Council and the Developers for their responses.

They have now responded, and the public’s legal team have now responded through the Courts to these responses.

Next stage is now waiting for the Court/Judge to grant or not permission to proceed to take the case to trial.

We now know IW Council and Developers wish to defend the case.

We also now know their defence and are strongly challenging it.

Our case is considered very strong and robust, and the Claim Bundle submitted to High Court is over 1,500 pages long!

When able, we’ll post more of the papers and evidence involved as they come into the public domain.

The recent flooding in Ryde, and the continuing release of sewage onto Ryde beaches, part of the internationally important Solent and Southampton Water Special Protection Area (SPA) marine reserve, makes us more determined to fight against inappropriate building on greenfield sites, especially so close to the coastline.

Please continue to support us as this case is about people power and standing up for community and the natural environment.

We have the evidence that the planning process and Isle of Wight Council have let the community down. They have failed us, and it’s not acceptable.

Our cause is just, and our determination unrelenting…
